Terms of Service

These Terms of Service govern your access to and use of the easykare website, software platform, and related services. By accessing or using the service, creating an account, or clicking to accept these terms, you agree to be bound by them.
Important compliance notice
easykare is not HIPAA compliant at this time and does not offer a Business Associate Agreement (BAA).
If your practice is required to use a HIPAA-compliant platform or to have a signed BAA in place before storing, transmitting, or processing protected health information (PHI), you must not sign up for or use easykare at this time.
1. About easykare
easykare is a practice management platform designed for solo wellness professionals and related practitioners. The Service may include booking pages, scheduling, client messaging, intake forms, session documentation, payments, reporting, and AI-assisted workflow tools.
easykare is a business-to-business software provider. We contract primarily with practitioners and authorized practice staff, not directly with their end clients or patients. Practitioners remain solely responsible for the professional services they provide and for compliance with applicable licensing, privacy, consent, and healthcare obligations.
2. Eligibility and authority
- You must be at least 18 years old and legally capable of entering into a binding agreement to use the Service.
- If you use the Service on behalf of a business or practice, you represent that you have authority to bind that entity.
- You may use the Service only in compliance with applicable laws, regulations, and professional obligations.
3. Accounts and security
- You must provide accurate, current, and complete account information and keep it updated.
- You are responsible for maintaining the confidentiality of account credentials and for all activity under your account.
- You must notify us promptly at [email protected] if you suspect unauthorized access or a security incident involving your account.
- You may not share access outside your authorized practice staff or permit unauthorized third parties to use the Service through your account.
4. Free trial, subscriptions, and billing
easykare may offer a free trial period. After any trial ends, continued access may require a paid subscription. Subscription terms, pricing, and included usage limits may be described on our pricing page, checkout flow, order form, or in-product billing screens.
- Subscriptions are billed in advance on a monthly or annual basis unless otherwise stated.
- You authorize us and our payment processors to charge applicable subscription and usage fees using the payment method on file.
- We may suspend or restrict access for failed payments, expired payment methods, or overdue balances.
- Except where required by law, fees are non-refundable once billed and we do not provide partial refunds for unused portions of a billing period.
- We may change pricing prospectively with reasonable advance notice.
5. Practitioner payment flows and Stripe
Payment processing for client-to-practitioner transactions may be provided by Stripe Connect or another third-party payments provider. If you use payment functionality through easykare, you may be required to accept the terms of those providers in addition to these Terms.
- easykare may charge platform or usage fees in connection with payment processing.
- You are responsible for taxes, refunds, chargebacks, disputes, and financial obligations related to your practice.
- easykare does not store full card numbers or full payment credentials.
- Payment disputes between practitioners and clients are governed by the applicable payment processor and the practitioner's own policies.
6. Acceptable use
You agree not to use the Service to:
- Violate any law, regulation, professional standard, or third-party right.
- Send unlawful, deceptive, abusive, or unsolicited communications.
- Store, transmit, or process data where you lack the necessary rights, notices, or consent.
- Probe, disrupt, reverse engineer, or interfere with the Service, its infrastructure, or other users.
- Upload malware or use the Service to compromise security, privacy, or availability.
- Resell, sublicense, scrape, or misuse the Service except as expressly permitted by us in writing.
We may investigate suspected misuse and suspend or terminate accounts that violate these Terms.
7. Practitioner responsibilities and client data
- You are responsible for the legality, accuracy, and integrity of the data you or your staff submit to the Service.
- You are responsible for obtaining all notices, consents, and authorizations required to collect, store, message, or otherwise process client information.
- You are responsible for determining whether your use of the Service is subject to HIPAA, PIPEDA, PHIPA, state privacy laws, or other healthcare-specific requirements.
- easykare is not HIPAA compliant at this time and does not provide a Business Associate Agreement.
- If your use case requires HIPAA compliance or a signed BAA before you store, transmit, or process PHI, you may not use the Service for that purpose and should not sign up until easykare expressly states that those capabilities are available.
8. SMS and communications compliance
easykare provides tools for transactional communications, including SMS and email. By using these tools, you agree that you will:
- Send messages only to recipients who have provided the necessary consent.
- Maintain records of consent where required.
- Honor opt-out requests promptly, including STOP-based SMS revocations.
- Use messaging features in compliance with TCPA, carrier rules, anti-spam laws, and comparable local requirements.

9. AI-assisted features
easykare may offer AI-assisted workflows such as receptionist responses, note drafting, summarization, and operational suggestions. These features are designed to assist, not replace, practitioner judgment.
- AI outputs may be incomplete, inaccurate, or inappropriate for a particular situation.
- You are responsible for reviewing AI-generated content before using it in practice operations or client communications.
- easykare is not responsible for clinical, business, or legal decisions made in reliance on AI-generated output.
10. Intellectual property and feedback
easykare and its licensors retain all rights, title, and interest in the Service, including software, interfaces, designs, branding, and documentation. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your internal practice operations.
You retain ownership of your data. You grant easykare a limited right to host, process, transmit, display, and use that data as necessary to provide, secure, support, and improve the Service in accordance with our Privacy Policy and contractual obligations.
If you provide feedback, suggestions, or ideas, we may use them without restriction or obligation to you.
11. Third-party services
The Service may interoperate with third-party products or services, including payment, messaging, authentication, calendar, hosting, analytics, storage, and AI providers. easykare is not responsible for third-party products or services, and your use of them may be governed by separate terms and privacy notices.
12. Suspension and termination
You may stop using the Service at any time. We may suspend, limit, or terminate access immediately if you violate these Terms, create risk to the Service or other users, fail to pay fees when due, or if we are required to do so by law.
After termination, certain rights and obligations survive, including those relating to accrued fees, intellectual property, confidentiality, limitations of liability, dispute resolution, and any data retention or deletion periods described in our policies or your agreement with us.
13. Disclaimers
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, EASYKARE DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
easykare does not provide medical, legal, compliance, billing, tax, or insurance advice and is not responsible for the professional services of practitioners using the platform.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EASYKARE'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO EASYKARE FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) $100 USD.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EASYKARE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
15. Indemnification
You agree to defend, indemnify, and hold harmless easykare and its officers, directors, employees, affiliates, and agents from and against claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service, your data, your communications with clients, your violation of these Terms, or your violation of applicable law or third-party rights.
16. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict of law rules.
Any dispute arising from or relating to these Terms or the Service will be resolved through binding arbitration on an individual basis in Texas, except that either party may seek injunctive or equitable relief in a state or federal court located in Texas to protect confidential information, intellectual property, or platform security.
The arbitration will be conducted in English by a single arbitrator. Unless applicable law requires otherwise, the arbitration will take place in Travis County, Texas. To the extent permitted by law, you waive any right to participate in a class action or class-wide arbitration.
17. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will post the updated Terms and revise the effective date above. Where appropriate, we may also provide additional notice. Your continued use of the Service after the effective date of the updated Terms constitutes acceptance of the revised Terms.
